1. General

These General Terms and Conditions apply to the sale and delivery of goods as well as the provision of services by PMS SAS GmbH.
Sales and deliveries are made exclusively to consumers and companies with residence or registered office in Europe.
By clicking on the “I have read and accept the terms and conditions” checkbox, the buyer agrees to these terms and conditions.
All offers on our website are subject to change, non-binding and only available while stocks last. A purchase contract only comes into effect upon dispatch of a confirmation or delivery.

2. Ordering process, order correction, order cancellation

• Products are placed in the shopping cart by clicking on them.
• Contents of the shopping cart can be viewed, changed or deleted at any time.
• The purchase process is completed by clicking on “order with obligation to pay”.
• Entries can be corrected at any time before submitting or the process can be cancelled.
• Registration is required for the first order

All contract content, information and communication are in German

4. Prices

• All prices include statutory VAT plus shipping costs.
• Additional fees such as customs duties or export taxes are borne by the customer

5. Right of withdrawal for consumers

• Consumers have the right to withdraw from the contract within 14 days without giving reasons.
• Deadlines begin with receipt of the goods or the last partial delivery.
• Revocation can be made by letter, e-mail or sample revocation form.
• Repayment will be made within 14 days via the original payment method.
• Return costs are borne by the consumer.
• No right of withdrawal for: personalized goods, sealed software, delivery of digital content after the start, services with express consent to immediate execution, urgent repairs.

6. PMS SAS Services / Terms of Use / Obligations to Cooperate

• Flights are only carried out in compliance with legal regulations.
• Conditions of use: no flight in rain, thunderstorms, at night, maximum 150 m altitude, visual contact required.
• The client provides a decision-making contact person and, if necessary, permits.
• In case of delay due to weather or authorities, the order can be postponed or terminated (in writing, period of 14 days).

7. Cancellation / Payments of orders (to be discussed, for the orders/ Solar/ Wildbach)

• 50% deposit upon placing the order, final payment upon delivery.
• Cancellation:
  • up to 7 days before the appointment: 30% fee
  • up to 3 days before the appointment: 50% fee
  • up to 48 hours: 70% fee
  • up to 24 hours: 100% fee

8. Copyright and rights of use

• All rights of use remain with PMS SAS GmbH until full payment has been received.
• Works may be used for own purposes, unless expressly transferred.

9. Terms of payment

• Accepted payment methods: Bank transfer, PayPal, instant transfer, Google Pay, Apple Pay
• Delivery will only take place after receipt of payment by bank transfer.

10. Late payment

• Default interest rate: Entrepreneur 9.2% above the base interest rate, consumer 4%.
• Flat rate for debt collection costs: EUR 40.

11. Reminder and collection charges

• Customer bears reasonable reminder and collection costs.
• Each reminder: EUR 19, record keeping: EUR 100 per half-year.

12. Default of acceptance

• In case of default of acceptance by entrepreneurs: Storage EUR 3 per day, at the same time obligation to fulfill the contract.

13. Retention of title

• Ownership of goods remains with PMS SAS GmbH until full payment.
• Resale only subject to retention of title.

15. Warranty, Liability, Guarantee

• Warranty: 24 months for goods, for services from conclusion.
• Report defects immediately.
• Liability only for intent and gross negligence; for consumers, also for slight negligence.
• Warranty terms see manufacturer or contract confirmation.

16. Applicable Law, Jurisdiction

• Austrian law applies.
• Consumers: Place of jurisdiction at the place of residence.
• Businesses: Place of jurisdiction at the company headquarters of PMS SAS GmbH.

17. Place of Performance for Business Transactions

• Place of performance is the company headquarters of PMS SAS GmbH.

18. Copyright / Website Content

• All content is for personal information and is protected by copyright.

19. Arbitration Board / ODR Platform

20. Delivery

• Delivery by DHL/UPS/Post.
• Partial deliveries will be charged, shipping costs only once per order.

23. Miscellaneous

• Recourse claims under the Product Liability Act are excluded, except in cases of gross negligence.
